Legal Notice

This is the corporate website of Iberdrola México, S.A. de C.V., a company that belongs to a group of companies headed by Iberdrola, S.A. This legal notice (hereinafter the «Legal Notice») governs the use of the services at the Web portal www.iberdrolamexico.com (hereinafter the «Portal») that Iberdrola México, S.A. de CV. (hereinafter «Iberdrola Mexico») provides you.

Portal access and use conditions

Accessing the Portal implies that Users have read and accepted this Legal Notice. By accessing and using the Portal, it shall be understood that the User expressly, fully, and unreservedly agrees to the content of each and every one of the parts of this Legal Notice, in the version published on the Portal at the time of access. If the User does not agree with the contents of this Legal Notice, they must refrain from accessing the Portal and using it. The Portal reserves the right to modify this Legal Notice and advising Users of such modifications through the relevant notices in the Portal, so that users are aware of its contents from the outset.

As a User, you declare that you are of legal age and/or have sufficient legal capacity to be bound by this Legal Notice and to use the Portal. The User expressly, fully, unreservedly, and without exception accepts that accessing and using the Portal and its contents shall be their sole and exclusive responsibility.

Portal contents

The Portal User assumes, knows and accepts, by the very fact of visiting the Portal, that the data and information contained in the Portal are displayed solely and exclusively for the purposes of information, and that it may, at any given time, contain errors, inaccuracies or have out of date contents.

Iberdrola Mexico reserves the right to modify, at its discretion and independently, at any time and without notice, the configuration of the Portal and the Portal access conditions. Similarly, Iberdrola Mexico reserves the right to add new services or content to the Portal, as well as the right to remove, limit, suspend or block access to the Portal, either temporarily or permanently.

Iberdrola informs the User they may access the pages of the companies that are part of the Iberdrola Group through the Portal. Iberdrola México assumes no responsibility and makes no guarantees regarding the products and services of these companies.

Processing of personal and sensitive data

In compliance with the Federal Law on the Protection of Personal Data Held by Individuals and its Regulations (LFPDPPP and RLFPDPPP), we inform the Portal User of the following:

The User is informed that there are cookies: cookies are small text files stored by the browser on the hard drive of the User’s computer. When visiting the Portal, our server will be able to recognize the relevant cookies, which shall provide us with information on your last visit. Most browsers accept the use of cookies automatically, but the User may configure their browser, so they are warned about cookies on their computer screen when they are detected and be able to prevent the installation of cookies on their hard drive. In any case, if you wish to activate the option to reject cookies, you may continue to use our website’s Service.

Iberdrola México undertakes to handle Users’ personal and/or sensitive data with strict confidentiality. Iberdrola Mexico informs you that it has implemented the necessary technical and organizational security measures to ensure the security of your personal data and prevent its alteration, loss, unauthorized handling and/or access, taking into account the state of technology, the nature of the data stored, and the risks to which they are exposed, whether from human acts, or the physical or natural surroundings.

General representations and warranties

Iberdrola México declares and guarantees that the Portal has the technology (software and hardware) necessary, to date, to allow it to be accessed and used. However, Iberdrola México México is not responsible for the possible presence of viruses or other harmful elements introduced by any means or by any third party, that may cause damage to the User’s computer systems, nor is it responsible for the harmful consequences that they may cause to the User’s computer systems. The User fully accepts the foregoing and undertakes to exercise, on their own behalf, the utmost diligence and care when accessing and using the Portal.

The User guarantees that any activities that they carry out using the Portal shall abide by the law, morality, generally accepted good practices and public order, and in no case be offensive to the good name and brand image of Iberdrola Mexico. The User undertakes to use the Portal correctly and diligently, and to refrain from using it for illegal purposes or effects, or for those purposes or effects prohibited by this Legal Notice.

The User agrees not to use the Portal for the purpose of causing harm to Iberdrola Mexico or any third party, related or not, to incite or promote criminal, disparaging, defamatory, offensive actions, or actions contrary to law, morals, generally accepted good practices or public order, or to promote discriminatory actions or ideas based on race, sex, ideology, religion or beliefs, to use intellectual or industrial property rights, to send e-mails, programs or data (including viruses and harmful software) through the Portal with fraudulent intent or by fault that cause or may cause damage or harm in any degree to the computer systems of Iberdrola, or other users, or third parties, including falsifying the origin of the email or other materials contained in a file sent through the Portal. They also agree to not use the information contained in the portal for direct sales or for any other purpose, or sending unsolicited messages addressed to a roughly broad range of people, regardless of their purpose.

General liability limits

Iberdrola México makes no representations or warranties of any kind, whether express or implied, regarding the operation of the Portal or the information, content, software, materials, or products included therein, to the extent permitted by applicable law. Also, Iberdrola Mexico is exempt from providing any guarantees, whether express or implied, including, but not limited to, implied guarantees of fitness for a particular purpose. Iberdrola Mexico shall not be liable for damage or losses of any kind that may arise from the use of this Portal, including, but not limited to, direct and indirect damages.

Iberdrola México is not liable for any security errors or vulnerabilities that may occur due to the User using an outdated or insecure version of a browser, as well as due to the User activating systems to save their User Identification details within the browser, or damage, errors or inaccuracies that may result from the malfunction of such systems.

Iberdrola México makes no warranties of any kind, either express or implied, with respect to the information that is transmitted, distributed, published or stored on the Portal, or the use that Users, their employees or third parties may make of it. Likewise, Iberdrola Mexico shall not be liable for the incapacity of any User, or the impersonation of a third party by a User.

The User shall be liable for damage or losses of any kind that Iberdrola México may suffer as a result, directly or indirectly, of a breach by the User of this Legal Notice.

All contents of the Portal (including, but not limited to, databases, images and photographs, patents, utility and industrial models, drawings, graphics, text files, audio, video and software) are owned by Iberdrola Mexico or its parent company or content providers, which, in the latter case, has been licensed by or transferred to them, and which are protected by Mexican intellectual property laws or international intellectual and industrial property standards. The compilation (understood as the collection, design, arrangement and assembly) of all the content of the Portal is the exclusive property of Iberdrola Mexico or its parent company and is protected by national and international intellectual and industrial property standards.

All software used in the design of the screens, navigation and use and development of the Portal is owned by Iberdrola Mexico or its parent company or its software providers and is protected by national and international intellectual and industrial property laws.

Iberdrola Mexico’s trademarks, labels, distinctive signs or logos that appear on the Portal are owned by Iberdrola Mexico or its parent company, and are duly registered as such, or in the process of registration. The names of other products and companies that appear in this document or on the Portal may be trademarks or other distinctive signs registered to their respective and rightful owners.

All text, designs, graphics, video or audio media are the property of Iberdrola México or its parent company, or its content providers, and may not be subject to further modification, copying, alteration, transformation, reproduction, adaptation or translation by the User or third parties without the express permission of the owners of such content.

Making databases, designs, graphics, images and photographs, text files, audio, video and software owned by Iberdrola Mexico or its parent company, or its providers that appear in the Portal, available to Users for their use does not imply, in any case, the transfer of ownership or the granting of a right of exploitation to the User, other than the right of use that involves the fair and legitimate use that is consistent with the nature of the Portal.

Any use of the contents of the Portal and, in general, of all the rights mentioned in the preceding paragraphs, is strictly prohibited without the authorization of Iberdrola Mexico, including its exploitation, reproduction, dissemination, transformation, distribution, transmission by any means, subsequent publication, display, public communication or total or partial representation, which, if they occur, will constitute a violation of the intellectual property rights of Iberdrola Mexico, punishable under applicable legislation.

Suspension of access to the portal

Iberdrola Mexico will endeavour to maintain the continued availability of the Portal. However, any form of testing, monitoring and maintenance operations will be freely selected and performed by Iberdrola México at any time, whatever the procedures and means used to carry them out. Iberdrola México will endeavour, whenever reasonably possible, to notify Users in an announcement on the Portal of any maintenance operation or other activity to be carried out that could affect the Portal.

Iberdrola México reserves full freedom to modify the transmission or tracking capabilities, or other technical means, used to access or use the Portal.

Iberdrola México may temporarily or permanently close the Portal, without incurring any indemnity to the User, when any of the following circumstances occur: (i) when necessary to perform maintenance work; (ii) when necessary to preserve the integrity or security of the Portal, equipment, systems or networks of Iberdrola Mexico or third parties, provided that they affect or may affect the services of Iberdrola Mexico; (iii) when justified by Iberdrola Mexico operational reasons, or those of third parties that affect Iberdrola Mexico; (iv) due to force majeure. Iberdrola Mexico will endeavour to keep the User informed of the closure and its causes, whenever possible.

Nullity and ineffectiveness of clauses

If any clause of this Legal Notice is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will only affect that provision or part of such clause that is null or ineffective, and the rest of the Legal Notice shall remain in force in all other respects. The provision or part of the clause that is affected shall be deemed not to have been included, unless, as it is essential to this Legal Notice, it should affect all clauses.

Jurisdiction and law applicable to the agreement

This Legal Notice shall be interpreted and governed pursuant to Mexican law.

By using the Portal, the User expressly accepts, in the event of any dispute, to submit to the jurisdiction of the competent courts of Mexico City, as well as to the laws in force in this location that apply to that case, expressly waiving their rights in any other jurisdiction that may apply to them by reason of their nationality or address.

Binding Corporate Rules (BCR)

Data transfers are carried out in accordance with applicable data protection laws and our Binding Corporate Rules («BCR»).

The Iberdrola Group’s BCRs reflect European legislation on data protection (General Data Protection Regulation). The fact of having the BCRs implies that all the companies in our Group that sign them have to comply with the same internal rules.
